What is separate property in divorce?

Separate property includes assets owned before marriage, inheritances received by one spouse, gifts given to one spouse, and property excluded by a prenuptial agreement. Separate property is generally not divided in divorce.

How is net worth divided in divorce?

It depends on your state. Nine states use community property rules where marital assets are generally split 50/50. The other 41 states use equitable distribution, meaning assets are divided fairly but not necessarily equally.

Yes. 401(k)s, IRAs, and pensions accumulated during the marriage are typically considered marital property and are subject to division. A Qualified Domestic Relations Order (QDRO) is often needed to divide retirement accounts.
