Acceptance of terms
By accessing or using DivorceSmart, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
Not financial, legal, or tax advice
DivorceSmart is an educational financial planning tool for informational purposes only. It is not a substitute for professional financial, legal, or tax advice and should not be relied upon as such. The service does not provide legal advice, financial advice, tax advice, or any other form of professional advice. DivorceSmart is not a law firm, financial advisory firm, accounting firm, or brokerage firm, and does not hold itself out as such.
Always consult a qualified attorney, Certified Divorce Financial Analyst (CDFA), certified financial planner, and/or tax professional before making any decisions about your divorce settlement. No information provided by DivorceSmart should be interpreted as a recommendation to take or refrain from taking any specific action.
Accuracy of projections and estimates
Our projections are estimates based on simplified financial planning assumptions including a default 5% annual investment return and 3% annual inflation rate. These projections are estimates only and are not guarantees of future financial outcomes. Actual results may differ significantly based on market conditions, tax implications, personal circumstances, changes in law, and many other factors that this tool cannot predict or account for.
DivorceSmart does not guarantee the accuracy, completeness, timeliness, or reliability of any projection, estimate, calculation, or information provided through the service. The tool uses simplified models that may not reflect the full complexity of your financial situation, applicable laws, or tax consequences.
AI-generated content
Certain features of DivorceSmart, including the Pro analysis, use artificial intelligence to generate written analysis and recommendations. AI-generated content is produced by automated systems and may contain errors, inaccuracies, or oversimplifications. AI-generated content does not constitute professional advice of any kind. You should independently verify any AI-generated information before relying on it and should always consult qualified professionals for advice specific to your situation.
State-specific information
DivorceSmart provides general informational content about divorce-related laws, formulas, and guidelines for various U.S. states. This information is for educational purposes only, may not be current, and may not reflect the laws of your specific jurisdiction. State laws regarding property division, alimony, child support, and taxation change frequently. The information presented may be outdated, simplified, or inaccurate for your particular state or circumstances. Do not rely on state-specific information provided by DivorceSmart as a basis for legal decisions. Always verify state-specific legal information with a licensed attorney in your jurisdiction.
Use of the service
You agree to use DivorceSmart for lawful purposes only. You are responsible for the accuracy of the information you enter. You acknowledge that the quality and relevance of projections depend on the accuracy of your inputs and the inherent limitations of simplified financial models.
Accounts and billing
Creating an account is optional for basic use. A one-time paid upgrade unlocks additional features including saved scenarios and comparisons. There is no recurring subscription — you pay once and retain access for the duration of your selected plan.
Disclaimer of warranties
DivorceSmart is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that projections will be accurate or suitable for any particular purpose.
Limitation of liability
To the fullest extent permitted by applicable law, DivorceSmart and its owners, operators, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
Without limiting the foregoing, we shall not be liable for any decisions made or actions taken by you based on the projections, estimates, information, or AI-generated content provided through the service. Your use of DivorceSmart is entirely at your own risk.
Indemnification
You agree to indemnify, defend, and hold harmless DivorceSmart and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to your use of the service, your reliance on any information provided by the service, or your violation of these Terms of Service.
Changes to these terms
We reserve the right to update these Terms of Service at any time. Changes will be effective upon posting. Your continued use of the service after any changes constitutes acceptance of the updated terms.
